These are the terms and conditions of Soil Fertility Testing and Consulting “SFTC” and covers all services rendered by SFTC. SFTC is a soil microbe test laboratory based in South Africa.

1. Test Requests

1.1 Tests will only be done on samples after payment is cleared in our bank and a duly completed Sample Submission Form for each sample was received;

1.2 All tests will only include the metrics as indicated in the service specification of the product and any additional requests will be charged for separately;

1.3 The sending and delivery of the sample is solely the responsibility of the customer and no responsibility will be accepted for lost or spoiled samples.

1.4 SFTC sample testing is a separate service from its consulting service and the sample testing does not include any consulting services.

2. Contact details

2.1 You must ensure that the contact details that SFTC hold for you is kept up to date or updated when you make use of our services. If you have not provided updated details SFTC will use the last details provided to it by yourself.

3. Test results

3.1 The test results will be sent to you as a link via the email on your contact details. You are solely responsible for security of email sent to the address you have maintained.

3.2 SFTC will only provide you with your test results:

3.2.1 if your account has been settled in full; and

3.2.2 you are legally entitled to receive the test results (i.e. they are your tests)

3.3 SFTC test results should be interpreted and explained to you by a knowledgeable person.

5. Payment for Test results

5.1 We can only accept payment via Electronic Fund Transfer into SFTC’s nominated bank account and consider payment to be received when the funds are cleared in our bank account.

5.2 Transaction currency is South African Rand (ZAR).

6. Jurisdiction

All services rendered by SFTC are governed by the laws of the Republic of South Africa and any dispute in terms of these terms and conditions will be subject to the exclusive jurisdiction of the High Court of South Africa, Western Cape Division, Cape Town for the institution of any legal proceedings herein.

7. SFTC reserves the right to amend these terms and conditions from time to time as required.

This site and all the information and all graphic representations or images on it belong to SFTC in the absence of any contrary indication. Copyright and all intellectual property rights, including but not limited to design rights, moral rights, and any similar rights, in any information and any graphics on this site or relating to it are vested in SFTC and reserved, subject to any contrary indication. All copying is forbidden other than in accordance with certain limited permissions:

Any views expressed in email messages are not that of SFTC unless expressly indicated by SFTC. No one may conclude a contract on behalf of SFTC by email without the express written confirmation by a duly authorised representative of SFTC.
